The Women’s Foundation of Colorado, Inc., a Colorado non-profit corporation (“WFCO” or “we”) respects your privacy and is committed to protecting it through our compliance with this policy. DISCLOSURE OF DONOR INFORMATION

Except as may be required by law, we will not sell, trade or share our donor’s names or personal information with any other third party, nor send mailings to donors on behalf of other organizations. Use of donor personal information (whether collected through our Website or offline) will be limited to the internal purposes of WFCO. To the extent any donations are processed through a third-party service provider, our donor’s information will only be used for purposes necessary to process the donation.

Disclosure of Your Aggregated Information

We may disclose to third parties aggregated information about our Website users, including donors, that does not identify any individual, without restriction.
Communication from WFCO

Whenever we send out donation requests or other marketing emails, we include an option to stop receiving such messages. If you do not wish to receive such communications from us, please exercise this option. In addition, you may contact us at any time to request that you be removed from our marketing email list by emailing us at wfco@wfco.org. Even if you opt-out, however, we might send you messages for non-marketing or administrative purposes like informing you of changes to the Website or providing you with donor receipts.

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

These Terms of Use are entered into by and between you and The Women’s Foundation of Colorado, Inc., a Colorado non-profit corporation (“WFCO”, “we” or “us”). Indemnification

Governing Law and Jurisdiction; Costs and Attorneys’ Fees

All matters relating to the Website and these Terms of Use and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of Colorado without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of Colorado, in each case located in the City and County of Denver. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

If you or WFCO commences any action or proceeding against the other to enforce these Terms of Use, or to recover damages or obtain injunctive or other relief resulting from the alleged breach of any provision of this Agreement, the prevailing party shall be entitled to recover all reasonable costs and expenses, including without limitation reasonable attorneys' fees.

Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

Copyright Infringement and the Digital Millennium Copyright Act

In accordance with the Digital Millennium Copyright Act ("DMCA"), and specifically 17 U.S.C. § 512(c)(3), a copyright agent has been designated to receive notification of a claimed copyright infringement for the Website. If you have posted User Contribution that is removed, and you believe such removal was a mistake or that you have the necessary licenses or permissions to post the User Contribution, you may send the copyright agent designated above a counter-notice. According to DMCA (17 U.S.C. § 512(g)(3)), the counter-notice must contain the following information:

Your physical or electronic signature.

  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which WFCO may be found, and that you will accept service of process from the person who provided the original notification or an agent of such person.

After receiving such a counter-notice, we may send a copy of it to the party who sent the original notice. If the owner of the copyright does not file a court action, WFCO, in its sole discretion, may replace or restore the removed User Contribution ten (10) or more days after receiving the counter-notice.

Additional Terms

These Terms of Use constitute the entire agreement between you and WFCO and supersede any prior understanding or agreements, oral or written. All captions, titles, headings, and divisions in these Terms of Use are for purposes of convenience and reference only, and shall not be construed to limit or affect the interpretation of the Terms of Use. You may not assign or delegate any of your rights or obligations under these Terms of Use. WFCO may assign these Terms of Use at its sole discretion, without notice, and at any time. No waiver of any default or breach of any agreement or provision herein contained shall be deemed a waiver of any other default or breach thereof or of any other agreement or provision herein contained. If any provision or portion of a provision of these Terms of Use is declared void and/or unenforceable, such provision or portion shall be deemed severed from these Terms of Use, which shall otherwise remain in full force and effect. The provisions of these Terms of Use shall inure to the benefit of, and be binding on, you and WFCO and yours and its successors, assigns, employees, legal representatives, heirs, distributees, and transferees, by operation of law, whether or not any such person shall become a party to these Terms of Use or have agreed in writing to join or be bound by the terms and conditions of these Terms of Use.
